5,000 Milk Gallon Donation Challenge



The 5,000 Milk Gallon Donation Challenge (“Program”) is open to legal residents of the fifty (50) United States and the District of Columbia, 18 years of age and older. Void where prohibited. Program is subject to all applicable federal, state and local laws and regulations.

Program Dates & Overview: Program starts on September 4, 2014 at 12:00 a.m. Eastern Time (“ET”) and ends on September 30, 2014 at 11:59 p.m. ET (“Program Period”). Participants will have the opportunity to donate to Feeding America through their Great American Milk Drive activation online or via text to help buy milk for members of their local community in need. At the end of the Program Period, National Fluid Milk Processor Promotion Board (“Milk”) will donate 5,000 gallons of milk to food banks located in the one (1) U.S. State that generated the highest cumulative donation total to food banks throughout their respective State during the Program Period. Donations will be evenly split amongst all Feeding America food banks throughout the winning state. Each gallon of the 5,000 gallon donation will be awarded in the form of a $5 manufacturer’s coupon, each redeemable for one (1) gallon of milk. The coupon can be redeemed for a milk value of $5.00. In most instances that covers a full gallon, however in some states where milk is more expensive, only a half-gallon may be able to be purchased. How to Participate: During the Program Period, you may donate to The Great American Milk Drive in one (1) of the following two (2) ways. The direction of the coupon will be determined by the donors credit card billing zip code. 1) Online: Visit www.milklife.com and follow the instructions to provide your information and select the amount you wish to donate. 2) Retail: Donations received at Great American Milk Drive sanctioned retailer programs will be included in the tallied total. 3) Processor Donations: Donations made by processors to the Great American Milk Drive during the month of September will be counted towards the total. Please note program compliance forms must be submitted within five (5) days of the donation in order to be included.  The 5,000 gallon milk donation to food banks located in the winning State will be made within sixty (60) days from the end date of the Program Period. General Conditions: Milk, Feeding America d/b/a The Great American Milk Drive and their respective parent companies, affiliates, subsidiaries and advertising and promotion agencies and (collectively, the “Released Parties”) are not responsible for lost, late, incomplete, inaccurate, or delayed donations, text messages, availability or accessibility or miscommunications or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or other errors or problems of any kind. Exact local food banks selected in the one (1) winning State to receive the proceeds of the 5,000 gallon donation to be determined by Milk, in its sole discretion. Should any portion of the Program be, in Milk’s sole opinion, compromised by non-authorized human intervention or other causes which, in the sole opinion of Milk, corrupt or impair the administration, security, fairness or submission of information, Milk reserves the right at its sole discretion to terminate the Program. By participating, you agree to be bound by these Terms and Conditions and the decisions of Milk which are final and binding.

Disputes: Except where prohibited, participant agrees that: (a) any and all disputes, claims and causes of action arising out of, or connected with, the Program shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the District of Columbia, USA; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in the Program, and in no event shall participant be entitled to receive attorneys’ fees or other legal costs or expenses; and (c) Participant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms and Conditions, participant’s rights and obligations, or the rights and obligations of Milk in connection with the Program, shall be governed by, and construed in accordance with, the laws of the District of Columbia, USA.
